Total failure of traffic lights, inc. Pelican crossing.
Thirty hours later, Highways Authority has still not attended and no attempt has been made to repair defect to three way traffic lights and light-controlled pedestrian crossing.
Total failure of this traffic lighting poses an ongoing, obvious and real risk to life, limb and property of motorists and pedestrians alike.
Does that failure to maintain amount to a breach of statutory duty under s.41 Highways Act 1980, on the part of the authority, Shropshire Council?
Here is the test -
"Has the failure to maintain resulted in the highway being in a dangerous state?" ---- Mills v Barnsley MBC [1992] PIQR
Key principles:
The Claimant must show both that:
(i) the defect posed a reasonably foreseeable risk of harm; and (ii) a reasonable person would regard is as presenting a real source of danger.
